Résumé Parce que les cloisons n'arrêtent que rarement les cris ou le bruit des coups administrés par l'un des conjoints sur l'autre, la justice pénale du XIXe siècle a dû très tôt se positionner. Si elle a dans un premier temps donné satisfaction aux plaintes des voisins importunés par le tapage ainsi causé, elle y a surtout trouvé de quoi légitimer son action en matière de violences conjugales. Cet article montre comment les magistrats, loin de s'être désintéressés de ces drames domestiques que sont les violences conjugales, ont, à partir du délit de tapage, contourné le droit opposable du mari de battre sa femme ; comment ils ont su faire de ce délit et des nuisances qu'il recouvre non seulement une circonstance accessoire de leur action, mais une circonstance aggravante des atteintes physiques à la personne.

Résumé anglais Because the partitions rarely stop the shouting or the noise of the blows administered by one spouse on the other, the Criminal Justice System of the 19th Century had to position itself very early on. Although it initially responded to complaints from neighbours who were annoyed by the noise, it found there, above all, a reason to legitimize its action in cases of domestic violence. This article therefore shows how judges, far from having lost interest in the domestic dramas, have, starting with the offence of disturbance, circumvented the opposable right of the husband to beat his wife; how they have been able to make this offence and the nuisance it covers not only an accessory circumstance to their action but also an aggravating circumstance of physical injury to the person.
