Écrit à l'occasion du 70e anniversaire de la Convention européenne des droits de l'homme, cet article cherche à identifier les paramètres, institutionnels et normatifs, qui mettent en évidence le caractère unique et le dynamisme de la Convention. Les éléments institutionnels comprennent le droit inconditionnel de recours individuel ; le caractère permanent de la Cour ; le mécanisme d'exécution unique ; l'adaptation continue des méthodes de travail de la Cour ; et les différentes formes de dialogue avec les autorités nationales. Les éléments d'ordre normatif sont notamment la pénétration de la Convention dans toutes les branches du droit interne ; l'interprétation évolutive, garante de la modernité du texte ; l'harmonisation des standards en matière de droits de l'homme au niveau paneuropéen et la création progressive d'une identité juridique européenne ayant des implications importantes pour la réunification et l'intégration européenne. Written on the occasion of the 70th anniversary of the European Convention on Human Rights, this article aims at identifying the institutional and normative elements which explain the unique character and dynamic of the European Convention. The institutional elements include the unconditional right of individual application, the permanent character of the Court, the unique execution mechanism, the continuous adaptation of the working methods of the Court, and the various forms of dialogue with national authorities. The normative elements include the penetration of the Convention into all branches of domestic law, the evolutive interpretation which guarantees the modernity of the text, the harmonisation of human rights standards at the pan-European level, and the progressive creation of a European legal identity with important implications for European reunification and integration.
