Résumé Le Protocole no 15 à la Convention européenne des droits de l'homme est entré en vigueur le 1er août 2021, près de huit années après son ouverture à la signature. Il s'inscrit dans le processus de réforme du système conventionnel, initié à la Conférence d'Interlaken, qui s'est poursuivi lors des Conférences d'Izmir et de Brighton. Il apporte cinq amendements à la Convention européenne des droits de l'homme destinés à renforcer l'efficacité du système conventionnel : ajout d'un considérant dans le préambule de la Convention faisant référence au principe de subsidiarité et à la doctrine de la marge d'appréciation ; suppression de la limite d'âge des juges ; réduction du délai de dépôt d'une requête ; renforcement du critère d'irrecevabilité du préjudice peu important et suppression du droit de veto en cas de dessaisissement au profit de la Grande Chambre. Ce texte, dont les effets devront être évalués, est un texte de compromis qui donne une illustration des conceptions parfois divergentes de la relation entre la Cour européenne des droits de l'homme et les États parties, et de l'équilibre, parfois fragile, de cette relation.

Résumé anglais Protocol No. 15 to the European Convention on Human Rights entered into force on 1st August 2021, almost eight years after it was opened for signature. This Protocol is part of the reform process of the system of the European Convention on Human Rights which was initiated at the Interlaken Conference, followed by the Izmir and Brighton Conferences. It introduces five amendments to the European Convention on Human Rights designed to make the Convention system more effective : the addition of a recital to the preamble of the Convention referring to the principle of subsidiarity and the margin of appreciation doctrine ; the abolition of the age limit for judges ; the reduction of the time limit for lodging an application ; the reinforcement of the criterion of inadmissibility of insignificant harm ; and the abolition of the right of veto in the relinquishment of jurisdiction to the Grand Chamber. This text, whose effects will have to be evaluated, is a compromise text that illustrates the divergent conceptions the High Contracting Parties may have on the Court-Member States relationship, and its sometimes fragile balance.
