Résumé De l'Organisation des Nations Unies à la Belgique en passant, notamment, par le Conseil de l'Europe et l'Union européenne, le droit au logement ne laisse aucune instance indifférente. En passant en revue quelques textes fondamentaux mais également des réflexions issues de différents comités, le droit au logement trouve ses bases dans un cadre supranational qui peut étayer notre réflexion sur ce besoin fondamental. Au niveau européen, le droit au logement n'est pas une compétence de l'Union. Il est donc laissé aux différents États membres d'inscrire (Belgique, Espagne...) ou de ne pas inscrire (Luxembourg, Grande-Bretagne...) ce droit dans leur constitution. Et même s'il est inscrit, l'application juridique diffère selon des normes constitutionnelles distinctes mais également suivant la répartition des compétences au niveau de chaque État membre.

Résumé anglais From United Nations Organization to Belgium through, among others, the Council of Europe and European Union, the right to housing leaves no authority unconcerned. Going through some fundamental texts as well as reflections from different committees, the right to housing has its roots in a supranational context which can act as a basis for our reflection on that fundamental need.At European level, the right to housing is not within the competence of the Union. It is to the different member States to mention (Belgium, Spain,...) or not this right in their consitution (Luxemburg, United Kingdom,...). And even if it is mentioned, the juridical enforcement differs according to distinct constitutional norms as well as according to the distribution of the competences at the level of each Member State.
