L'article 7 de la Charte de l'environnement consacre le droit de participation des citoyens aux décisions relatives à l'environnement. Le législateur est donc constitutionnellement tenu de mettre en place les procédés nécessaires à l'intervention du public. Un tel droit n'a rien d'absolu puisqu'il se limite aux « décisions publiques ayant une incidence sur l'environnement ». Le constituant a ainsi utilisé une formule ambigüe qui restreint la participation citoyenne à certaines décisions environnementales. Il revient alors au Conseil constitutionnel de déterminer les décisions environnementales pouvant faire l'objet d'une telle participation. En venant préciser la notion de « décision publique ayant une incidence sur l'environnement », le contrôle de constitutionnalité détermine parallèlement l'effectivité de ce nouveau droit constitutionnel pour la démocratie environnementale. Article 7 of the Environmental Charter enshrines the right of citizens to participate in decisions relating to the environment. Therefore, the legislator is constitutionally bound to elaborate procedures allowing public intervention. Such a right is by no means absolute since it is limited to "public decisions affecting the environment". The constituent thus used an ambiguous formula which restricts public participation to some decisions. It is then up to the Constitutional Council to determine which ones be concerned by public participation. By clarifying the notion of "public decision having affecting the environment", the control of constitutionality simultaneously determines the effectiveness of this new constitutional right for environmental democracy.
