Au prisme de la sociologie du droit et à travers une approche processuelle, cet article interroge le principe constitutionnel de « sincérité budgétaire », ordinairement présenté par la doctrine comme incertain et ineffectif. Il analyse les mobilisations en faveur de ce principe depuis les années 1990 et les luttes pour sa définition, entre simple respect du droit à l'information du Parlement et instrument plus formalisé de discipline budgétaire. Il examine les divers effets produits par l'existence de cette ressource mobilisable qu'est la règle de droit, en soulignant les retraductions politiques et médiatiques dont il fait l'objet. Ce faisant, il donne à voir l'évolution des rapports de force à l'œuvre dans l'élaboration des lois de finances et met au jour une tension entre juridicisation et politisation des textes financiers. Drawing on the sociology of law and politics and using a processual approach, this article intends to grasp the meaning of the French constitutional principle of “budgetary sincerity,” described by lawyers as uncertain and ineffective. It analyzes the advocacy for and struggles over the interpretation of the principle since the 1990s and shows that the concept is seen either as a simple tool for ensuring Parliament's right to fiscal information or as a more formalized instrument of budgetary discipline. Lastly, it assesses the effects, be they juridical or not, that the principle produces in the public debate and highlights the political and mediatic uses of the notion. In doing so, the article describes the evolution of French budgetary policymaking and discloses a tension between juridicization and politicization of budget acts. Source : Éditeur (via Cairn.info) |
