Le juge est-il source de/du droit ou source de normes ? Question essentielle, en ce sens qu'elle vise à circonscrire, pour autant que cela soit possible, l'office du juge. La doctrine n'étant pas disposée à s'accorder sur ce point, des hésitations existent autour de cette question. Au fondement de ces hésitations, une instabilité notionnelle matérialisée par des incertitudes sur les différences entre texte et signification du texte, juridicité et normativité, norme et signification. Le juge est-il créateur de droit, simple interprète ou véritable garant de la norme ? L'office du juge correspond-il à un pouvoir juridique ou à un pouvoir normatif ? En cherchant à comprendre les assises intellectuelles et théoriques des hésitations autour du rôle théorique du juge, il apparaît que l'office du juge ne serait pas tant éloigné de l'idée de source de norme. Is the judge a source of law/the law or a source of norms? This is an essential question, in the sense that it seeks to determine – as far as it is actually possible – the real role of the judge. As legal opinion has tended to differ on this point, there is still some hesitancy around this issue. What underlies that hesitation is a notional instability that takes the form of uncertainty with regard to the difference between the word of the law and the meaning of the word of the law, juridicity and normativity, norm and meaning, etc. Is the judge a creator of law, a mere interpreter of law or a true guarantor of the norm? Do they represent a juridical power or a normative power? By seeking to understand the intellectual and theoretical foundations of the hesitancy around the prerogatives of the judge, it seems that their role is not so far from that of a source of norms.
