| Résumé |
Avant 1945, le droit de la fonction publique faisait partie intégrante du droit administratif et assurait aux agents publics des avantages considérables par rapport aux employés privés. Après une période transitoire, le Code du travail de 1950 a unifié la réglementation applicable à l'ensemble des travailleurs. Depuis le nouveau Code du travail entré en vigueur en 1968, seules les questions de principe et les droits et devoirs fondamentaux des travailleurs sont codifiés dans un texte unique, les règles spéciales applicables aux fonctionnaires étant fixées par décrets ministériels. Les conditions de nomination, le niveau de qualification des travailleurs, leurs obligations ainsi que la cessation des rapports de travail font ainsi l'objet de dispositions spécifiques applicables soit en considération de l'administration employeur, soit en considération du niveau des fonctions exercées. The evolution of the right of the civil service in Hungary
Before 1945, the Right of the Civil Service formed an integral part of the administrative Right and assured the civil servants considerable advantages compared to private employees.
After a period of transition, the Work Code of 1950 standardized the rules applicable to all workers. Since the new Work Code was adopted in 1968, only questions of principles, fundamental rights and obligations of workers were codified in an unique text, the special rules applicable to civil servants being fixed by ministerial decree.
The conditions of entry, the level of qualification of the workers, their obligations as well as the termination of their service are thus the object of specific provisions applicable either as a consideration of the employing administration or as a consideration of the level of their functions.
