Le droit applicable aux soins psychiatriques demeure marqué par la contrainte. Malgré la disparition de la figure du fou dangereux et l'émergence d'un statut juridique du patient atteint de troubles mentaux, une tension subsiste entre l'affirmation de ses droits et la persistance d'un corpus normatif majoritairement centré sur la prise en charge sans consentement, fondée sur des logiques sécuritaires. The law applying to psychiatric care is still characterised by constraint. Despite the disappearance of the image of the dangerous madman and the emergence of a legal status for patients with mental disorders, a tension remains between the assertion of their rights and the persistence of a body of law that is mainly focused on involuntary treatment, based on security considerations.
