    Emmanuel Macron se veut le président d'une Ve République revenue à ses sources gaulliennes, dirigée par un président transformateur, incarnant le pays par-delà droite et gauche. Mais la Ve République n'a survécu qu'en démentant cette illusion originelle de De Gaulle. Le Général pourfendait le régime des partis, mais l'a revigoré, certes sous la domination d'un présidentialisme que d'ailleurs le huitième président perpétue sans inflexion majeure. La vision gaullienne des institutions avec laquelle Macron renoue pourrait s'avérer à son tour une illusion.
    Emmanuel Macron wants to be the president of a Fifth Republic that has reverted to its Gaullist roots, led by a transformative president embodying the country beyond right and left. But the Fifth Republic has only survived by contradicting De Gaulle's original illusion. The General lambasted the party system, yet he strengthened it, albeit under the domination of a presidential system that the eighth president is perpetuating without significant change. The Gaullist vision of the institutions which Macron has embraced could prove to be another illusion.

    La doctrine n'est pas tenue à l'écart du processus de révision constitutionnelle. Elle l'alimente abondamment mais par des voies complexes qui restent à identifier. Pour ce faire, le recours à l'histoire intellectuelle est indispensable. En s'intéressant aux modalités concrètes de production et de diffusion des idées à travers un entrelacs de lieux, de milieux et de réseaux où se meuvent les constitutionnalistes, il est ici de mettre en lumière ce processus à travers le rôle de revues comme Pouvoirs, en prenant pour exemple l'introduction de la question prioritaire de constitutionnalité ou en analysant la fonction des comités chargés de préparer les réformes institutionnelles.
    Doctrine is not put aside in the constitutional revision process. It feeds it abundantly in complex ways that remain to be identified. Intellectual history can help us do that. The article takes into consideration the actual mode of production and dissemination of ideas through the maze of spaces, environments and networks inhabited by constitutionalists, and it tries to highlight this process by focusing on the role played by journals such as Pouvoirs around two issues : the introduction of the priority preliminary ruling on constitutionality and the function of the committees in charge of preparing constitutional reforms.

    La Constitution de la Ve République a été révisée à vingt-quatre reprises. Elle est et demeure d'abord le texte d'organisation des pouvoirs publics. Mais, avec ces révisions, elle l'est moins et est devenue, dans le même temps, le siège des droits et libertés fondamentaux du fait des révisions de 1974 et de 2008, qui assurent la justiciabilité de toutes les dispositions constitutionnelles.
    The Constitution of the Fifth Republic has undergone twenty-four revisions. It has been and remains the text that organizes the government. Through these revisions, however, it is less so and has become the foundation of fundamental rights and liberties following the 1974 and 2008 revisions, which guarantee the justiciability of all constitutional provisions.

Ce faisant, il aborde la question des dialogues entre histoire et pouvoir, autour des jeux passé-présent initiés autour de cet événement.
    How can one understand the failures of the constitutional revision announced by François Hollande in the aftermath of the November 2015 terrorist attacks ? The article proposes to re-examine this episode by offering a historian's reading presented according to different temporalities. By doing so, it raises the issue of the dialogue between history and power, around the confrontation between past and present initiated by this event.

    À son origine, la Constitution intéressait les sources du droit privé essentiellement parce qu'elle délimitait les compétences de la loi et du règlement. Progressivement, à partir du début 1970, elle a changé de nature, pour devenir, par différents mécanismes, procéduraux comme substantiels, source du droit privé. La Constitution y a gagné une dimension horizontale. L'argument constitutionnel est entré dans les prétoires. Mais cette mutation, fondamentale, ne se fait pas sans difficultés. La Constitution reste un corps étranger au droit privé, dont la réception et l'acclimatation sont incertaines.
    From the start, the Constitution concerned the sources of private law essentially because it defined the competences of laws and regulations. Since the beginning of the 1970s, it has gradually changed in nature and has become, through various procedural as well as substantial mechanisms, the source of private law. The Constitution has thus acquired a horizontal dimension. The constitutional argument has entered the courtrooms. However, this fundamental mutation has not occurred without difficulties. For private law, the Constitution remains a foreign body, which reception and acclimatization are still uncertain.

Tant le dispositif constitutionnel (la Constitution et son interprétation) que les règles du jeu électoral (mode de scrutin et calendrier) ont veillé à ce que les chambres respectent la préséance du pouvoir présidentiel. La pratique des acteurs parlementaires, tant dans l'usage que ces derniers ont fait de leurs pouvoirs que dans leur incapacité à utiliser les ressources du bicamérisme, a achevé d'ancrer cette subordination dans le long terme.
    The founding fathers of the 1958 Constitution wanted to relegate Parliament to a secondary role within the institutions and they have durably succeeded in doing so. Both the constitutional framework (the Constitution and its interpretation) and the electoral rules (voting system and schedule) have made sure that the two chambers would respect the precedence of presidential power. The practice of parliamentary actors, both in the usage they have made of their powers and their inability to use the resources of bicameralism, has ensured the long-term sustainability of this subordination.

    Peut-être plus qu'aucune autre, la question de la décentralisation est hautement politique, et les pouvoirs accordés aux territoires ont fluctué au gré des alternances politiques, parfois dans des proportions radicales. D'un caractère « indivisible » jusqu'à la prochaine et probable indépendance de la Nouvelle-Calédonie, en passant par la constitutionnalisation de son organisation « décentralisée », la Ve République peut aussi se raconter à travers le récit du rapport entre le centre et les territoires. La séculaire opposition entre jacobins et girondins, même éloignée de son sens révolutionnaire, semble persister. L'approche chronologique de ce grand récit permet d'y positionner nos huit présidents et de mieux comprendre le « pacte girondin » qui devrait trouver une traduction dans la prochaine révision constitutionnelle.
    More than any other, the question of decentralization is quintessentially political, and the competences granted to the regions have varied, sometimes significantly, according to which party was in power. Declared “indivisible”, until the upcoming and probable independence of New Caledonia and without forgetting the constitutionalizing of its “decentralized” organization, the Fifth Republic can also be described through the history of the relationship between the centre and the regions. The centuries-old opposition between Jacobins and Girondists, even deprived of its revolutionary meaning, seems to have survived. A chronological approach to this great narrative allows us to see where each of the eight presidents have stood and to understand more clearly the “Girondist pact” which should be reflected in the next constitutional revision.

    La loi de 1881 sur la liberté d'expression est toujours un pilier de notre État de droit, dans la Ve République. Cette loi installe un équilibre entre une liberté d'expression première, ne nécessitant aucune autorisation administrative préalable, et la définition d'abus de type pénal, sanctionnés a posteriori, donc. Cet équilibre légal est cependant défié et fragilisé : par le fonctionnement des réseaux sociaux, ou encore par l'atmosphère de suspicion qui entoure les délits contre les personnes (concurrence des mémoires et des souffrances). Cependant, le légalisme – attitude consistant à régler tous les problèmes par la loi – se porte bien (peut-être aux fins d'impressionner l'opinion), malgré les problèmes qu'il pose sur des sujets comme le hate speech ou les fake news.
    Under the Fifth Republic, the 1881 legislation on the freedom of expression has remained a pillar of the rule of law. It introduced a balance between a fundamental freedom of expression, which requires no prior administrative authorization, and the definition of criminal offences punishable a posteriori. However, this legal balance has been challenged and undermined either by the functioning of social medias or by the climate of suspicion that surrounds offences against individuals (due to the rivalry between memories or sufferings). Nevertheless, legalism is alive and well (maybe so as to impress public opinion), despite the problems it raises on issues such as hate speech and fake news.

Avec des modalités pratiques diverses, dont cet article tente d'ébaucher une typologie, de nouveaux pans de l'exercice démocratique s'offriraient à nous. En miroir, l'appropriation par le législateur de ces nouvelles problématiques doit également être interrogée.
    The digital revolution has opened the way for a renewal of the citizens' participation in the political decision-making process. Through various arrangements, of which the article offers a draft typology, new domains of participatory democracy could be opened to us. Conversely, the appropriation of these new issues by the law-makers should also be questioned.

    Federalizing the Eurozone is an idea that has been around for some time. Lately, it has come again to the fore under the impulsion of the French president, Emmanuel Macron. Starting with the notion of federation in the process of European integration, the article offers a critical and contextualized analysis of the different national and European proposals, which oscillate between the federalization of competences and the participation of citizens.

    Sous la bannière faussement univoque d'une nouvelle ou « 6e » République se distinguent deux options constitutionnelles qui prétendent l'une et l'autre s'attaquer au présidentialisme débridé de nos institutions. La première veut conforter le pouvoir présidentiel face au Premier ministre dans le cadre d'un régime présidentiel « à la française », lorsque la seconde voudrait le neutraliser sur le modèle des régimes primo-ministériels européens. Les deux n'en procèdent pas moins d'une illusion, celle d'un véritable changement de régime qui pourrait faire l'économie d'une réforme du mode d'élection du chef de l'État.
    Under the falsely univocal banner calling for a new or “Sixth” Republic, two different constitutional options can be distinguished which both claim to attack the unbridled presidentialism of our institutions. The first offers to consolidate the president's power vis-à-vis the Prime minister in a French-style presidential regime, while the second would like to neutralize it on the model of the European prime-ministerial regimes. But both derive from an illusion, namely that a genuine change of regime could take place without a reform of the mode of election of the head of State.
