La fonction consultative du Conseil d'État témoigne du dit et du non-dit : ce qui est légitimement attendu, l'analyse du droit et de l'opportunité administrative, côtoie le sous-jacent : l'appui apporté au gouvernement dans différents arbitrages et l'aide dans la conduite de négociations. Autorité morale, l'institution est un acteur majeur du processus de décision gouvernementale. Mais, au-delà du bel ordonnancement combiné de neutralité politique et d'expertise juridique, l'expression consultative ne devrait-elle pas traduire la volonté engagée d'une institution au service de l'État ? The advisory nature of the Council of State partakes of spoken and un-spoken rules. What is expected, i.e. the analysis of the law and of administrative opportunity, goes together with the underlying, i.e. the support given to the government in different arbitrations as well as help in negotiations. This institution plays a major role in the process of governmental decisions. Yet, beyond the pleasant combination of political neutrality and judicial expertise, its consultative function should maybe express the determination of an institution at the service of the state.
